Ethiopia Builds the Nuclear Rulebook Before the Reactor

Ethiopia has moved another step toward establishing the institutional foundations required for a future nuclear-power programme, with the Ethiopian Technology Authority convening stakeholders to review draft regulations governing nuclear installations.

The consultation, announced on 4 August, brought together government agencies, professional organisations and partners as Ethiopia develops requirements covering nuclear-site selection, environmental and public protection, natural and human-induced hazards, emergency arrangements and other elements of nuclear installation regulation.

The Authority says it is also developing capabilities covering licensing, inspections, enforcement and human resources as part of a broader effort to establish a regulatory structure aligned with international nuclear-safety standards.

For NuclearAfrica, the development is important precisely because no reactor has been approved for construction.

It is evidence of a principle that should shape every newcomer nuclear programme: the rules, regulator and institutions must begin developing before the reactor.

Regulation is nuclear infrastructure

Public attention around new nuclear programmes tends to concentrate on vendors.

Which country will provide the reactor? How large will it be? Will it be an SMR? Where will it be built?

But the IAEA’s Milestones Approach treats nuclear infrastructure much more broadly. It covers 19 interconnected issues spanning national policy, legal and regulatory frameworks, human resources, safeguards, security, environmental protection, emergency planning, radioactive waste, financing, procurement and other areas.

A functioning regulatory system is therefore not administrative paperwork that follows a technology choice.

It is part of the infrastructure needed to determine whether a technology can be accepted at all.

What Ethiopia is developing

According to the Ethiopian Technology Authority, the draft regulations incorporate requirements relating to site-selection criteria, protection of people and the environment, mitigation of natural and human-induced hazards and emergency-response arrangements.

The Authority’s Director-General, Solomon Getachew, also said work is advancing on human-resource development, legal drafting, licensing processes, inspection procedures and enforcement mechanisms.

These areas become increasingly important as a nuclear programme matures.

A future licence application cannot credibly be assessed unless the regulator has already established what evidence is required from the applicant, how technical reviews will be performed, what inspections will be carried out and what enforcement actions can be taken if requirements are not met.

Regulation must remain independent of promotion

There is another important institutional lesson.

Countries entering nuclear power commonly create organisations to promote the programme while simultaneously expanding or establishing the regulator.

Those functions should remain institutionally distinct.

The organisation responsible for delivering nuclear power has an interest in project progress. The regulator’s obligation is different: it must determine whether safety and legal requirements have been met, irrespective of political or commercial schedules.

This distinction becomes particularly important when governments are eager to show rapid progress.

Regulatory development may appear slower and less politically visible than signing a vendor memorandum, but it is far more important to the legitimacy of the eventual project.

Ethiopia is still at an early stage

The latest development should therefore not be interpreted as approval to construct a nuclear power plant.

The regulations remain draft instruments undergoing stakeholder consideration. The consultation does not constitute selection of a reactor technology, approval of a nuclear site, issuance of a construction licence or a commitment to a particular commissioning date.

That distinction matters because nuclear programmes can spend many years developing national infrastructure before construction becomes appropriate.

The IAEA describes its Milestones Approach as a progressive process in which countries assess readiness before moving into progressively more resource-intensive phases.

Developing robust regulations now can therefore be viewed not as evidence that a reactor is imminent, but as an attempt to create the institutional conditions under which future decisions can eventually be made responsibly.

Why This Matters for Africa

Ethiopia’s regulatory work offers a useful contrast with the vendor-centred narrative surrounding much of Africa’s nuclear expansion.

The continent’s nuclear progress should not be measured simply by the number of cooperation agreements signed.

A more meaningful dashboard would track whether countries have established independent regulators, comprehensive nuclear legislation, siting requirements, licensing procedures, safeguards arrangements, emergency frameworks, waste policies and competent personnel.

On that basis, drafting nuclear-installation regulations is a substantive development.

The same lesson applies to Ghana, Kenya, Nigeria, Rwanda, Uganda, Zambia and other states investigating nuclear power.

A serious nuclear programme is visible not merely when politicians announce reactors, but when institutions quietly develop the capability to say yes, no, or not yet on technical and safety grounds.

That is why Ethiopia’s latest step deserves attention.

It is not yet building a nuclear reactor.

It is beginning to build something that must come first: the regulatory system within which any future reactor would have to operate.
